The statutory entitlement in 5 days. This means employees have a right to 5 days domestic violence leave in any consecutive 12 months.
Employers can give their employees more than the statutory entitlement, and may give the employee additional paid or unpaid special leave, if required.
Part-time employees are entitled to domestic violence leave on a pro-rata basis.
EXAMPLE: If they work 50% of a normal working week, they're entitled to 2.5 days leave.
The leave doesn't need to be taken all at once, it can be taken as single or consecutive days.
An absence for part of a day is counted as one full day.
Domestic violence leave is paid by the employer at the employee's full rate of pay.
Employees must be paid at their normal daily rate of pay.
CAUTION: Don't make any reference to domestic violence leave on the employee's payslip.
